Terms of service

Effective July 21, 2026

These Terms of Service (“Terms”) govern your access to and use of the AmberPen website, proofreading API, SDKs, documentation, and related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you use the Service for an organization, you represent that you have authority to bind that organization, and “you” includes it.

Accounts and eligibility

You must be legally able to enter into these Terms and provide accurate account information. You are responsible for activity under your account and for keeping credentials and API keys secure. Notify us promptly if you suspect unauthorized use.

Using the Service

Subject to these Terms and payment of applicable fees, AmberPen grants you a limited, non-exclusive, non-transferable right to access and use the Service for your internal or customer-facing applications. You may use our SDKs and documentation under the licenses or notices supplied with them.

You may not:

  • use the Service in violation of law or another person’s rights;
  • submit malware or content intended to disrupt, damage, or gain unauthorized access;
  • probe or bypass rate limits, access controls, or security measures;
  • resell or provide the Service as a standalone product without our written permission; or
  • reverse engineer the Service except to the extent such a restriction is prohibited by law.

Customer content

You retain all rights to text, dictionary entries, and other content you submit (“Customer Content”). You grant AmberPen a limited license to host, process, transmit, and display Customer Content only as needed to provide, secure, and support the Service and comply with law. You are responsible for having the rights and permissions needed to submit Customer Content.

AmberPen does not use Customer Content to train machine-learning models. Our handling of Customer Content and personal information is described in our Privacy policy.

Corrections and output

Proofreading is automated and may produce incomplete, incorrect, or unsuitable corrections. You are responsible for reviewing output before relying on or publishing it, especially in legal, medical, financial, safety-critical, or other high-impact contexts. AmberPen does not provide professional advice.

Fees and subscriptions

Paid plans are billed according to the pricing and billing period shown when you subscribe or in an order form. Usage above an included allowance may incur additional charges. Except where law requires otherwise, fees are non-refundable and exclude taxes. We may change pricing on advance notice, with changes applying from your next renewal unless stated otherwise.

Service changes and availability

We may improve, modify, suspend, or discontinue features of the Service. We aim to keep the Service available but do not promise uninterrupted or error-free operation unless a separate service-level agreement says otherwise. Preview or beta features may change or be withdrawn at any time.

Ownership and feedback

AmberPen and its licensors own the Service, including its software, design, and documentation, excluding Customer Content and third-party materials. If you provide feedback, you grant us a perpetual, worldwide right to use it without restriction or compensation, provided we do not identify you publicly without permission.

Third-party services

The Service relies on third-party infrastructure and may link to other services. AmberPen is not responsible for third-party services, which are governed by their own terms and policies.

Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, create security or legal risk, fail to pay amounts due, or if necessary to protect the Service or other users. Where practical, we will give notice and an opportunity to cure. Provisions that by their nature should survive termination will remain in effect.

Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” AmberPen disclaims all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

Limitation of liability

To the maximum extent permitted by law, AmberPen will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or business opportunities. AmberPen’s total liability arising out of the Service or these Terms will not exceed the amount you paid AmberPen for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited.

Indemnification

To the extent permitted by law, you will defend and indemnify AmberPen and its personnel against third-party claims arising from your Customer Content, your applications, or your material breach of these Terms or applicable law.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which AmberPen is incorporated, without regard to conflict-of-law rules. Courts located in that jurisdiction will have exclusive jurisdiction, except where applicable consumer law gives you the right to bring a claim elsewhere.

Changes to these Terms

We may update these Terms as the Service or law changes. We will post the revised Terms and update the effective date. Material changes will take effect after reasonable notice when required. By continuing to use the Service after the updated Terms take effect, you agree to them.
